Apart from being able to tell your bank where to stick their £30-£40 bank charges, you can apparantly now back-claim for the last six years. I say apparantly as I've not yet tried, but be sure to watch this space!

Bank and card companies charge us £12 to £40 for exceeding overdraft limits, making late payments, defaulting on debts, returning a bounced cheque, or for failed direct debits and standing orders. However, it is unlawful for them to penalise us financially for any of these breaches of contract, or any other breach in fact! And we've just let them get on with it. How British!

But not all of us have just sat there and taken it. Thousands of people have recovered their charges, with an average recovery of £956. With the help of the following articles, you could do this too!

Banks have been charging their customers extortionate amounts whenever they go overdrawn, a cheque is bounced, a direct debit payment is paid late, etc. According to the Unfair Terms in Consumer Contracts Regulations 1999, a company cannot charge more than the cost incurred to itself from a customer for late payments and the like. Therefore banks cannot charge more than the cost to itself when you go overdrawn or a cheque is bounced, etc.

The European of Office of Fair Trading has clarified the issue with bank charges in a new ruling made on the 6th April 2006. Follow this link to see the document: http://www.oft.gov.uk/News/Press+releases/2006/68-06.htm.

I have successfully reclaimed £1,087.89 from my bank. It took just under two months from the date of my first letter to the bank to receiving the £1,087.89. This is probably as long as it could ever likely take as my bank was quite difficult.
